摘要
司法獨(dú)立是西方國家乃至世界大多數(shù)國家司法制度的基本原則之一。我國現(xiàn)行憲法第126條規(guī)定：“人民法院依照法律規(guī)定獨(dú)立行使審判權(quán)，不受行政機(jī)關(guān)、社會(huì)團(tuán)體和個(gè)人的干涉”；第131條規(guī)定：“人民檢察院依照法律規(guī)定獨(dú)立行使檢察權(quán)，不受行政機(jī)關(guān)、社會(huì)團(tuán)體和個(gè)人的干涉”。但其在司法實(shí)踐中，真正意義上的司法獨(dú)立或者審判獨(dú)立在世界任何一個(gè)角落都未實(shí)現(xiàn)。本文將從司法獨(dú)立的歷史淵源入手，論述了司法獨(dú)立的淵源、發(fā)展、司法獨(dú)立的內(nèi)涵，以及我國目前司法獨(dú)立的狀況，最后將從給出對策落筆。

On Judicial independence

Abstract
The judicial independence is one of the basic principles of the judicial system of most countries in western countries and even world. Judicial independence is the guarantee of just judicial system. Article 126 of current constitution of our country stipulates: “the people's court administers justice independently according to the legal provisions, is free from any inference by administrative organ, public organization and individual ”, article 131 stipulates: “ the people's procuratorate exercises the right of procuratorial work independently according to the legal provisions, is free from any inference by administrative organ, public organization and individual ”. But the fact is not like this . This text will proceed with historical origin of the judicial independence, describe the intension of the origin, development, judicial independence of the judicial independence, and the state of the judicial independence at present of our country, will start to write or draw from the countermeasure of providing finally.
