勞動(dòng)教養(yǎng)制度的改革探析
摘要
勞動(dòng)教養(yǎng)制度自上世界50年代在我國(guó)建立起來(lái),在這半個(gè)多世界的歷史長(zhǎng)河中,其在維護(hù)我國(guó)社會(huì)治安秩序,社會(huì)穩(wěn)定和預(yù)防犯罪中有著重大的貢獻(xiàn)。但是,隨著我國(guó)政治、經(jīng)濟(jì)、文化水平的不斷提高,社會(huì)主義法治體系不斷完善,勞動(dòng)教養(yǎng)自身的弊端也日益顯露出來(lái)。我國(guó)自2003年收容遣送制度被廢除以后,社會(huì)各界關(guān)于勞動(dòng)教養(yǎng)制度的“廢”、“立”的爭(zhēng)議便一直不斷,而最近由于一些與勞動(dòng)教養(yǎng)密切相關(guān)的一些事件使得勞動(dòng)教養(yǎng)的缺陷的顯現(xiàn)更加突出,雖然這從側(cè)面也體現(xiàn)除了我國(guó)人民的法律素養(yǎng)不斷在提高人權(quán)意識(shí)不斷增強(qiáng),但是勞動(dòng)教養(yǎng)何去何從才能符合我國(guó)的社會(huì)主義法治要求,更好的發(fā)揮其維護(hù)我國(guó)社會(huì)穩(wěn)定,預(yù)防和減少犯罪的重要任務(wù)是我國(guó)當(dāng)前法治建設(shè)的一個(gè)重要問(wèn)題,本文立足于我國(guó)的特殊國(guó)情和勞動(dòng)教養(yǎng)自身的歷史與現(xiàn)狀,通過(guò)對(duì)有關(guān)勞動(dòng)的教養(yǎng)制度“廢立之爭(zhēng)”的評(píng)論和剖析,旨在為勞動(dòng)教養(yǎng)制度的改革做一些有效探析,為我國(guó)勞動(dòng)教養(yǎng)制度的發(fā)展和完善做參考,為我國(guó)社會(huì)主義法治建設(shè)做貢獻(xiàn)。

Probe into the reform of the system of reeducation through labor
Abstract
The system of reeducation through labor from the last 50 years the world was established in China, in which more than half a century of history, in the maintenance of China's social order, and it contributes to social stability and the prevention of crime. However, as China's political, economic, cultural level unceasing enhancement, the socialistic legal system perfection of reeducation through labor, its defects are also increasingly exposed. China sent since 2003 after the detention was abolished, social all circles about the system of reeducation through labor "waste", "Li" controversy has been continuously, and recently because of some events and reeducation through labor is closely related to the defects of reeducation through labor appear more prominent, although this also from the side reflects in addition to legal literacy in China People's increasing awareness of human rights is increasing, but decide on what path to follow in order to meet the requirements of the socialist rule of law of reeducation through labor in China, the maintenance of social stability in our country, the important task of prevention and reduction of crime is an important problem in the construction of rule of law in our country at present, the special conditions and reeducation through labor history and current situation of their own based on in our country, based on the system of reeducation through labor "dethronement contend for" review and analysis, aims to do some effective exploration for the reform of the system of reeducation through labor, as a reference for the development of the system of reeducation through labor in China and perfect, make contributions to the construction of socialist rule of law in china.

勞動(dòng)教養(yǎng)制度自建立以來(lái),已經(jīng)過(guò)了半個(gè)多世界,在這六十多年的歷史長(zhǎng)河中,為維護(hù)國(guó)家社會(huì)穩(wěn)定和社會(huì)治安秩序起著非常重要的作用,但隨著我國(guó)經(jīng)濟(jì)政治文化法制的不斷發(fā)展和完善,勞動(dòng)教養(yǎng)制度本身的缺陷也逐漸顯現(xiàn)出來(lái),特別是我國(guó)自改革開放以來(lái)不斷加入到國(guó)際事物中,在國(guó)際社會(huì)的影響力不斷上升,這對(duì)我國(guó)來(lái)說(shuō)是一個(gè)機(jī)會(huì)也是一個(gè)挑戰(zhàn)。因此,只有把我國(guó)的各項(xiàng)制度順利的與國(guó)際接軌才能促進(jìn)我國(guó)的發(fā)展了,特別是我國(guó)的法治領(lǐng)域。雖然我國(guó)社會(huì)主義法制體系已經(jīng)建成,但在法律實(shí)踐中出現(xiàn)的許多問(wèn)題還有待解決,如何把懲罰犯罪和保障人權(quán)能效結(jié)合便是我國(guó)當(dāng)前法治的重要問(wèn)題,而法治、人權(quán)問(wèn)話題在國(guó)際交流和國(guó)際事務(wù)中的猶如家常便飯一般,因此在國(guó)際社會(huì)中我國(guó)的勞動(dòng)教養(yǎng)制度由于自身的一些缺陷而經(jīng)常遭受到其他國(guó)家的攻擊和指責(zé),而近年來(lái)國(guó)內(nèi)出現(xiàn)的一系列公共事件又與勞動(dòng)教養(yǎng)有關(guān),勞動(dòng)教養(yǎng)制度迅速成為社會(huì)的焦點(diǎn),在社會(huì)上引起了熱議。本課題便是立足于此而產(chǎn)生的。
本課題的意義在于:通過(guò)研究勞動(dòng)教養(yǎng)制度歷史和現(xiàn)狀,找出其本身的缺點(diǎn),從而對(duì)癥下藥,解決該制度的法治危機(jī)。使其符合我國(guó)社會(huì)主義法治的要求,能夠更好的保障人權(quán)和維護(hù)國(guó)內(nèi)社會(huì)穩(wěn)定。
