The Legal regulations on Abuse of Market domination Status
【Abstract】 The market domination status means the dominant position that an undertaking possesses because of its superior powers. The position enables it to neglect, restrict or exclude competition. Market share is the decisive factor, but not the only factor to be taken into account, to determine if an undertaking possesses dominant position. There is not much difference in the understanding of the 6 kinds of typical abuse behavior in the international antimonopoly practice. The present regulations of our country on abuse of dominance scatter in multi-level legal origins and various acts. And there exist a great many of problems, which need to be resolved according to the legislation of regulation on abuse of dominance in the antimonopoly legislation. China's antimonopoly act should categorize the different status of market dominations as monopoly, paramount market position and oligopoly, at the same time make stipulations that an undertaking may be presumed to be dominant for its market shares beyond a certain extent. The stipulations on abuse should take the way of Summarizing and Enumerating.
