《中華人民共和國野生動(dòng)物保護(hù)法》已由中華人民共和國第七屆全國人民代表大會(huì)常務(wù)委員會(huì)第四次會(huì)議于1988年11月8日通過,現(xiàn)予公布,自1989年3月1日起施行。

第一章 總 則
第一條 為保護(hù)、拯救珍貴、瀕危野生動(dòng)物,保護(hù)、發(fā)展和合理利用野生動(dòng)物資源,維護(hù)生態(tài)平衡,制定本法。
第二條 在中華人民共和國境內(nèi)從事野生動(dòng)物的保護(hù)、馴養(yǎng)繁殖、開發(fā)利用活動(dòng),必須遵守本法。
本法規(guī)定保護(hù)的野生動(dòng)物,是指珍貴、瀕危的陸生、水生野生動(dòng)物和有益的或者有重要經(jīng)濟(jì)、科學(xué)研究價(jià)值的陸生野生動(dòng)物。
本法各條款所提野生動(dòng)物,均系指前款規(guī)定的受保護(hù)的野生動(dòng)物。
珍貴、瀕危的水生野生動(dòng)物以外的其他水生野生動(dòng)物的保護(hù),適用漁業(yè)法的規(guī)定。
第三條 野生動(dòng)物資源屬于國家所有。
國家保護(hù)依法開發(fā)利用野生動(dòng)物資源的單位和個(gè)人的合法權(quán)益。
第四條 國家對(duì)野生動(dòng)物實(shí)行加強(qiáng)資源保護(hù)、積極馴養(yǎng)繁殖、合理開發(fā)利用的方針,鼓勵(lì)開展野生動(dòng)物科學(xué)研究。
在野生動(dòng)物資源保護(hù)、科學(xué)研究和馴養(yǎng)繁殖方面成績顯著的單位和個(gè)人,由政府給予獎(jiǎng)勵(lì)。
第五條 中華人民共和國公民有保護(hù)野生動(dòng)物資源的義務(wù),對(duì)侵占或者破壞野生動(dòng)物資源的行為有權(quán)檢舉和控告。
第六條 各級(jí)政府應(yīng)當(dāng)加強(qiáng)對(duì)野生動(dòng)物資源的管理,制定保護(hù)、發(fā)展和合理利用野生動(dòng)物資源的規(guī)劃和措施。
第七條 國務(wù)院林業(yè)、漁業(yè)行政主管部門分別主管全國陸生、水生野生動(dòng)物管理工作。
省、自治區(qū)、直轄市政府林業(yè)行政主管部門主管本行政區(qū)域內(nèi)陸生野生動(dòng)物管理工作。自治州、縣和市政府陸生野生動(dòng)物管理工作的行政主管部門,由省、自治區(qū)、直轄市政府確定。
縣級(jí)以上地方政府漁業(yè)行政主管部門主管本行政區(qū)域內(nèi)水生野生動(dòng)物管理工作。

第二章 野生動(dòng)物保護(hù)
第八條 國家保護(hù)野生動(dòng)物及其生存環(huán)境,禁止任何單位和個(gè)人非法獵捕或者破壞。
第九條 國家對(duì)珍貴、瀕危的野生動(dòng)物實(shí)行重點(diǎn)保護(hù)。國家重點(diǎn)保護(hù)的野生動(dòng)物分為一級(jí)保護(hù)野生動(dòng)物和二級(jí)保護(hù)野生動(dòng)物。國家重點(diǎn)保護(hù)的野生動(dòng)物名錄及其調(diào)整,由國務(wù)院野生動(dòng)物行政主管部門制定,報(bào)國務(wù)院批準(zhǔn)公布。
地方重點(diǎn)保護(hù)野生動(dòng)物,是指國家重點(diǎn)保護(hù)野生動(dòng)物以外,由省、自治區(qū)、直轄市重點(diǎn)保護(hù)的野生動(dòng)物。地方重點(diǎn)保護(hù)野生動(dòng)物名錄,由省、自治區(qū)、直轄市政府制定并公布,報(bào)國務(wù)院備案。
國家保護(hù)的有益的或者有重要經(jīng)濟(jì)、科學(xué)研究價(jià)值的陸生野生動(dòng)物名錄及其調(diào)整,由國務(wù)院野生動(dòng)物行政主管部門制定并公布。
第十條 國務(wù)院野生動(dòng)物行政主管部門和省、自治區(qū)、直轄市政府,應(yīng)當(dāng)在國家和地方重點(diǎn)保護(hù)野生動(dòng)物的主要生息繁衍的地區(qū)和水域,劃定自然保護(hù)區(qū),加強(qiáng)對(duì)國家和地方重點(diǎn)保護(hù)野生動(dòng)物及其生存環(huán)境的保護(hù)管理。
自然保護(hù)區(qū)的劃定和管理,按照國務(wù)院有關(guān)規(guī)定辦理。
第十一條 各級(jí)野生動(dòng)物行政主管部門應(yīng)當(dāng)監(jiān)視、監(jiān)測(cè)環(huán)境對(duì)野生動(dòng)物的影響。由于環(huán)境影響對(duì)野生動(dòng)物造成危害時(shí),野生動(dòng)物行政主管部門應(yīng)當(dāng)會(huì)同有關(guān)部門進(jìn)行調(diào)查處理。
第十二條 建設(shè)項(xiàng)目對(duì)國家或者地方重點(diǎn)保護(hù)野生動(dòng)物的生存環(huán)境產(chǎn)生不利影響的,建設(shè)單位應(yīng)當(dāng)提交環(huán)境影響報(bào)告書;環(huán)境保護(hù)部門在審批時(shí),應(yīng)當(dāng)征求同級(jí)野生動(dòng)物行政主管部門的意見。
第十三條 國家和地方重點(diǎn)保護(hù)野生動(dòng)物受到自然災(zāi)害威脅時(shí),當(dāng)?shù)卣畱?yīng)當(dāng)及時(shí)采取拯救措施。
第十四條 因保護(hù)國家和地方重點(diǎn)保護(hù)野生動(dòng)物,造成農(nóng)作物或者其他損失的,由當(dāng)?shù)卣o予補(bǔ)償。補(bǔ)償辦法由省、自治區(qū)、直轄市政府制定。

第三章 野生動(dòng)物管理
第十五條 野生動(dòng)物行政主管部門應(yīng)當(dāng)定期組織對(duì)野生動(dòng)物資源的調(diào)查,建立野生動(dòng)物資源檔案。
第十六條 禁止獵捕、殺害國家重點(diǎn)保護(hù)野生動(dòng)物。因科學(xué)研究、馴養(yǎng)繁殖、展覽或者其他特殊情況,需要捕捉、捕撈國家一級(jí)保護(hù)野生動(dòng)物的,必須向國務(wù)院野生動(dòng)物行政主管部門申請(qǐng)?zhí)卦S獵捕證;獵捕國家二級(jí)保護(hù)野生動(dòng)物的,必須向省、自治區(qū)、直轄市政府野生動(dòng)物行政主管部門申請(qǐng)?zhí)卦S獵捕證。
第十七條 國家鼓勵(lì)馴養(yǎng)繁殖野生動(dòng)物。馴養(yǎng)繁殖國家重點(diǎn)保護(hù)野生動(dòng)物的,應(yīng)當(dāng)持有許可證。許可證的管理辦法由國務(wù)院野生動(dòng)物行政主管部門制定。
第十八條 獵捕非國家重點(diǎn)保護(hù)野生動(dòng)物的,必須取得狩獵證,并且服從獵捕量限額管理。
持槍獵捕的,必須取得縣、市公安機(jī)關(guān)核發(fā)的持槍證。
第十九條 獵捕者應(yīng)當(dāng)按照特許獵捕證、狩獵證規(guī)定的種類、數(shù)量、地點(diǎn)和期限進(jìn)行獵捕。
第二十條 在自然保護(hù)區(qū)、禁獵區(qū)和禁獵期內(nèi),禁止獵捕和其他妨礙野生動(dòng)物生息繁衍的活動(dòng)。
禁獵區(qū)和禁獵期以及禁止使用的獵捕工具和方法,由縣級(jí)以上政府或者其野生動(dòng)物行政主管部門規(guī)定。
第二十一條 禁止使用軍用武器、毒藥、炸藥進(jìn)行獵捕。
獵槍及彈具的生產(chǎn)、銷售和使用管理辦法,由國務(wù)院林業(yè)行政主管部門會(huì)同公安部門制定,報(bào)國務(wù)院批準(zhǔn)施行。
第二十二條 禁止出售、收購國家重點(diǎn)保護(hù)野生動(dòng)物或者其產(chǎn)品。因科學(xué)研究、馴養(yǎng)繁殖、展覽等特殊情況,需要出售、收購、利用國家一級(jí)保護(hù)野生動(dòng)物或者其產(chǎn)品的,必須經(jīng)國務(wù)院野生動(dòng)物行政主管部門或者其授權(quán)的單位批準(zhǔn);需要出售、收購、利用國家二級(jí)保護(hù)野生動(dòng)物或者其產(chǎn)品的,必須經(jīng)省、自治區(qū)、直轄市政府野生動(dòng)物行政主管部門或者其授權(quán)的單位批準(zhǔn)。
馴養(yǎng)繁殖國家重點(diǎn)保護(hù)野生動(dòng)物的單位和個(gè)人可以憑馴養(yǎng)繁殖許可證向政府指定的收購單位,按照規(guī)定出售國家重點(diǎn)保護(hù)野生動(dòng)物或者其產(chǎn)品。
工商行政管理部門對(duì)進(jìn)入市場(chǎng)的野生動(dòng)物或者其產(chǎn)品,應(yīng)當(dāng)進(jìn)行監(jiān)督管理。
第二十三條 運(yùn)輸、攜帶國家重點(diǎn)保護(hù)野生動(dòng)物或者其產(chǎn)品出縣境的,必須經(jīng)省、自治區(qū)、直轄市政府野生動(dòng)物行政主管部門或者其授權(quán)的單位批準(zhǔn)。
第二十四條 出口國家重點(diǎn)保護(hù)野生動(dòng)物或者其產(chǎn)品的,進(jìn)出口中國參加的國際公約所限制進(jìn)出口的野生動(dòng)物或者其產(chǎn)品的,必須經(jīng)國務(wù)院野生動(dòng)物行政主管部門或者國務(wù)院批準(zhǔn),并取得國家瀕危物種進(jìn)出口管理機(jī)構(gòu)核發(fā)的允許進(jìn)出口證明書。海關(guān)憑允許進(jìn)出口證明書查驗(yàn)放行。
涉及科學(xué)技術(shù)保密野生動(dòng)物物種的出口,按照國務(wù)院有關(guān)規(guī)定辦理。
第二十五條 禁止偽造、倒賣、轉(zhuǎn)讓特許獵捕證、狩獵證、馴養(yǎng)繁殖許可證和允許進(jìn)出口證明書。
第二十六條 外國人在中國境內(nèi)對(duì)國家重點(diǎn)保護(hù)野生動(dòng)物進(jìn)行野外考察或者在野外拍攝電影、錄像,必須經(jīng)國務(wù)院野生動(dòng)物行政主管部門或者其授權(quán)的單位批準(zhǔn)。
建立對(duì)外國人開放的獵捕場(chǎng)所,必須經(jīng)國務(wù)院野生動(dòng)物行政主管部門批準(zhǔn)。
第二十七條 經(jīng)營利用野生動(dòng)物或者其產(chǎn)品的,應(yīng)當(dāng)繳納野生動(dòng)物資源保護(hù)管理費(fèi)。收費(fèi)標(biāo)準(zhǔn)和辦法由國務(wù)院野生動(dòng)物行政主管部門會(huì)同財(cái)政、物價(jià)部門制定,報(bào)國務(wù)院批準(zhǔn)后施行。
第二十八條 因獵捕野生動(dòng)物造成農(nóng)作物或者其他損失的,由獵捕者負(fù)責(zé)賠償。
第二十九條 有關(guān)地方政府應(yīng)當(dāng)采取措施,預(yù)防、控制野生動(dòng)物所造成的危害,保障人畜安全和農(nóng)業(yè)、林業(yè)生產(chǎn)。
第三十條 地方重點(diǎn)保護(hù)野生動(dòng)物和其他非國家重點(diǎn)保護(hù)野生動(dòng)物的管理辦法,由省、自治區(qū)、直轄市人民代表大會(huì)常務(wù)委員會(huì)制定。

第四章 法律責(zé)任
第三十一條 非法捕殺國家重點(diǎn)保護(hù)野生動(dòng)物的,依照關(guān)于懲治捕殺國家重點(diǎn)保護(hù)的珍貴、瀕危野生動(dòng)犯罪的補(bǔ)充規(guī)定追究刑事責(zé)任。
第三十二條 違反本法規(guī)定,在禁獵區(qū)、禁獵期或者使用禁用的工具、方法獵捕野生動(dòng)物的,由野生動(dòng)物行政主管部門沒收獵獲物、獵捕工具和違法所得,處以罰款;情節(jié)嚴(yán)重、構(gòu)成犯罪的,依照刑法第一百三十條的規(guī)定追究刑事責(zé)任。
第三十三條 違反本法規(guī)定,未取得狩獵證或者未按狩獵證規(guī)定獵捕野生動(dòng)物的,由野生動(dòng)物行政主管部門沒收獵獲物和違法所得,處以罰款,并可以沒收獵捕工具,吊銷狩獵證。
違反本法規(guī)定,未取得持槍證獵捕野生動(dòng)物的,由公安機(jī)關(guān)比照治安管理處罰條例的規(guī)定處罰。
第三十四條 違反本法規(guī)定,在自然保護(hù)區(qū)、禁獵區(qū)破壞國家或者地方重點(diǎn)保護(hù)野生動(dòng)物主要生息繁衍場(chǎng)所的,由野生動(dòng)物行政主管部門責(zé)令停止破壞行為,限期恢復(fù)原狀,處以罰款。
第三十五條 違反本法規(guī)定,出售、收購、運(yùn)輸、攜帶國家或者地方重點(diǎn)保護(hù)野生動(dòng)物或者其產(chǎn)品的,由工商行政管理部門沒收實(shí)物和違法所得,可以并處罰款。
違反本法規(guī)定,出售、收購國家重點(diǎn)保護(hù)野生動(dòng)物或者其產(chǎn)品,情節(jié)嚴(yán)重、構(gòu)成投機(jī)倒把罪、走私罪的,依照刑法有關(guān)規(guī)定追究刑事責(zé)任。
沒收的實(shí)物,由野生動(dòng)物行政主管部門或者其授權(quán)的單位按照規(guī)定處理。
第三十六條 非法進(jìn)出口野生動(dòng)物或者其產(chǎn)品的,由海關(guān)依照海關(guān)法處罰;情節(jié)嚴(yán)重、構(gòu)成犯罪的,依照刑法關(guān)于走私罪的規(guī)定追究刑事責(zé)任。
第三十七條 偽造、倒賣、轉(zhuǎn)讓特許獵捕證、狩獵證、馴養(yǎng)繁殖許可證或者允許進(jìn)出口證明書的,由野生動(dòng)物行政主管部門或者工商行政管理部門吊銷證件,沒收違法所得,可以并處罰款。
偽造、倒賣特許獵捕證或者允許進(jìn)出口證明書,情節(jié)嚴(yán)重、構(gòu)成犯罪的,比照刑法第一百六十七條的規(guī)定追究刑事責(zé)任。
第三十八條 野生動(dòng)物行政主管部門的工作人員玩忽職守、濫用職權(quán)、徇私舞弊的,由其所在單位或者上級(jí)主管機(jī)關(guān)給予行政處分;情節(jié)嚴(yán)重、構(gòu)成犯罪的,依法追究刑事責(zé)任。
第三十九條 當(dāng)事人對(duì)行政處罰決定不服的,可以在接到處罰通知之日起十五日內(nèi),向作出處罰決定機(jī)關(guān)的上一級(jí)機(jī)關(guān)申請(qǐng)復(fù)議;對(duì)上一級(jí)機(jī)關(guān)的復(fù)議決定不服的,可以在接到復(fù)議決定通知之日起十五日內(nèi),向法院起訴。當(dāng)事人也可以在接到處罰通知之日起十五日內(nèi),直接向法院起訴。當(dāng)事人逾期不申請(qǐng)復(fù)議或者不向法院起訴又不履行處罰決定的,由作出處罰決定的機(jī)關(guān)申請(qǐng)法院強(qiáng)制執(zhí)行。
對(duì)海關(guān)處罰或者治安管理處罰不服的,依照海關(guān)法或者治安管理處罰條例的規(guī)定辦理。

第五章 附 則
第四十條 中華人民共和國締結(jié)或者參加的與保護(hù)野生動(dòng)物有關(guān)的國際條約與本法有不同規(guī)定的,適用國際條約的規(guī)定,但中華人民共和國聲明保留的條款除外。
第四十一條 國務(wù)院野生動(dòng)物行政主管部門根據(jù)本法制定實(shí)施條例,報(bào)國務(wù)院批準(zhǔn)施行。
省、自治區(qū)、直轄市人民代表大會(huì)常務(wù)委員會(huì)可以根據(jù)本法制定實(shí)施辦法。
第四十二條 本法自1989年3月1日起施行。

附:有關(guān)法律條文
一、刑法有關(guān)規(guī)定
《刑法》第一百一十六條 違反海關(guān)法規(guī),進(jìn)行走私
,情節(jié)嚴(yán)重的,除按照海關(guān)法規(guī)沒收走私物品并且可以罰
款外,處三年以下有期徒刑或者拘役,可以并處沒收財(cái)產(chǎn)。
《刑法》第一百一十七條 違反金融、外匯、金銀、
工商管理法規(guī),投機(jī)倒把,情節(jié)嚴(yán)重的,處三年以下有期
徒刑或者拘役,可以并處、單處罰金或者沒收財(cái)產(chǎn)。
《刑法》第一百一十八條 以走私、投機(jī)倒把為常業(yè)
的,走私、投機(jī)倒把數(shù)額巨大的或者走私、投機(jī)倒把集團(tuán)
的首要分子,處三年以上十年以下有期徒刑,可以并處沒
收財(cái)產(chǎn)。
《刑法》第一百三十條 違反狩獵法規(guī),在禁獵區(qū)、
禁獵期或者使用禁用的工具、方法進(jìn)行狩獵,破壞珍禽、
珍獸或者其他野生動(dòng)物資源,情節(jié)嚴(yán)重的,處二年以下有
期徒刑、拘役或者罰金。
《刑法》第一百六十七條 偽造、變?cè)旎蛘弑I竊、搶
奪、毀滅國家機(jī)關(guān)、企業(yè)、事業(yè)單位、人民團(tuán)體的公文、
證件、印章的,處三年以下有期徒刑、拘役、管制或者剝
奪政治權(quán)利;情節(jié)嚴(yán)重的,處三年以上十年以下有期徒刑。
《全國人民代表大會(huì)常務(wù)委員會(huì)關(guān)于嚴(yán)懲嚴(yán)重破壞經(jīng)
濟(jì)的罪犯的決定》第一條
對(duì)刑法第一百一十八條走私、套匯、投機(jī)倒把牟取暴
利罪,第一百五十二條盜竊罪,第一百七十一條販毒罪,
第一百七十三條盜運(yùn)珍貴文物出口罪,其處刑分別補(bǔ)充或
者修改為:情節(jié)嚴(yán)重的,處十年以上有期徒刑、無期徒刑
或者死刑,可以并處沒收財(cái)產(chǎn)。
《全國人民代表大會(huì)常務(wù)委員會(huì)關(guān)于懲治走私罪的補(bǔ)
充規(guī)定》第二條
走私國家禁止出口的文物、珍貴動(dòng)物及其制品、黃金
、白銀或者其他貴重金屬的,處五年以上有期徒刑,并處
罰金或者沒收財(cái)產(chǎn);情節(jié)特別嚴(yán)重的,處無期徒刑或者死
刑,并處沒收財(cái)產(chǎn);情節(jié)較輕的,處五年以下有期徒刑,
并處罰金。
二、《海關(guān)法》有關(guān)規(guī)定
第四十七條 逃避海關(guān)監(jiān)管,有下列行為之一的,是
走私罪:
(一)運(yùn)輸、攜帶、郵寄國家禁止進(jìn)出口的毒品、武
器、偽造貨幣進(jìn)出境的,以牟利、傳播為目的運(yùn)輸、攜帶
、郵寄淫穢物品進(jìn)出境的,或者運(yùn)輸、攜帶、郵寄國家禁
止出口的文物出境的;
(二)以牟利為目的,運(yùn)輸、攜帶、郵寄除前項(xiàng)所列
物品外的國家禁止進(jìn)出口的其他物品、國家限制進(jìn)出口或
者依法應(yīng)當(dāng)繳納關(guān)稅的貨物、物品進(jìn)出境,數(shù)額較大的;

第四十八條 有本法第四十七條第(二)、(三)項(xiàng)
所列行為之一,走私貨物、物品數(shù)額不大的,或者攜帶、
郵寄淫穢物品進(jìn)出境不構(gòu)成走私罪的,由海關(guān)沒收貨物、
物品、違法所得,可以并處罰款。
三、《治安管理處罰條例》有關(guān)規(guī)定
第二十條 有下列妨害公共安全行為之一的,處十五
日以下拘留、二百元以下罰款或者警告:
(一)非法攜帶、存放槍支、彈藥或者有其他違反槍
支管理規(guī)定行為,尚不夠刑事處罰的;

Chapter I General Provisions
Article 1
This Law is formulated for the purpose of protecting and saving the
species of wildlife which are rare or near extinction, protecting,
developing and rationally utilizing wildlife resources and maintaining
ecological balances.
Article 2
All activities within the territory of the People's Republic of China
concerning the protection, domestication, breeding, development and
utilization of species of wildlife must be conducted in conformity with
this Law.
The wildlife protected under this Law refers to the species of terrestrial
and aquatic wildlife which are rare or near extinction and the species of
terrestrial wildlife which are beneficial or of important economic or
scientific value.
The wildlife referred to in the provisions of this Law means the wildlife
which shall enjoy protection as prescribed in the preceding paragraph.
As regards the protection of the species of aquatic wildlife other than
those which are rare or near extinction, the provisions of the Fisheries
Law shall apply.
Article 3
Wildlife resources shall be owned by the State.
The State shall protect the lawful rights and interests of units and
individuals engaged in the development or utilization of wildlife
resources according to law.
Article 4
The State shall pursue a policy of strengthening the protection of
wildlife resources, actively domesticating and breeding the species of
wildlife, and rationally developing and utilizing wildlife resources, and
encourage scientific research on wildlife.
Units and individuals that have made outstanding achievements in the
protection of wildlife resources, in scientific research on wildlife, or
in the domestication and breeding of wildlife shall be awarded by the
State.
Article 5
Citizens of the People's Republic of China shall have the duty to protect
wildlife resources and the right to inform the authorities of or file
charges against acts of seizure or destruction of wildlife resources.
Article 6
The governments at various levels shall strengthen the administration of
wildlife resources and formulate plans and measures for the protection,
development and rational utilization of wildlife resources.
Article 7
The departments of forestry and fishery administration under the State
Council shall be respectively responsible for the nationwide
administration of terrestrial and aquatic wildlife.
The departments of forestry administration under the governments of
provinces, autonomous regions and municipalities directly under the
Central Government shall be responsible for the administration of
terrestrial wildlife in their respective areas. The departments in charge
of the administration of terrestrial wildlife under the governments of
autonomous prefectures, counties and municipalities shall be designated by
the governments of provinces, autonomous regions or municipalities
directly under the Central Government.
The departments of fishery administration under the local governments at
or above the county level shall be responsible for the administration of
aquatic wildlife in their respective areas.

Chapter II Protection of Wildlife
Article 8
The State shall protect wildlife and the environment for its survival, and
shall prohibit the illegal hunting, catching or destruction of wildlife by
any unit or individual.
Article 9
The State shall give special protection to the species of wildlife which
are rare or near extinction. The wildlife under special state protection
shall consist of two classes: wildlife under first class protection and
wildlife under second class protection. Lists or revised lists of wildlife
under special state protection shall be drawn up by the department of
wildlife administration under the State Council and announced after being
submitted to and approved by the State Council.
The wildlife under special local protection, being different from the
wildlife under special state protection, refers to the wildlife specially
protected by provinces, autonomous regions or municipalities directly
under the Central Government. Lists of wildlife under special local
protection shall be drawn up and announced by the governments of
provinces, autonomous regions or municipalities directly under the Central
Government and shall be submitted to the State Council for the record.
Lists or revised lists of terrestrial wildlife under state protection,
which are beneficial or of important economic or scientific value, shall
be drawn up and announced by the department of wildlife administration
under the State Council.
Article 10
The department of wildlife administration under the State Council and
governments of provinces, autonomous regions and municipalities directly
under the Central Government shall, in the main districts and water areas
where wildlife under special state or local protection lives and breeds,
designate nature reserves and strengthen the protection and administration
of wildlife under special state or local protection and the environment
for its survival.
The designation and administration of nature reserves shall be effected in
accordance with the relevant provisions of the State Council.
Article 11
Departments of wildlife administration at various levels shall keep watch
on and monitor the impact of the environment on wildlife. If the
environmental impact causes harm to wildlife, the departments of wildlife
administration shall conduct investigation and deal with the matter
jointly with the departments concerned.
Article 12
If a construction project produces adverse effects on the environment for
the survival of wildlife under special state or local protection, the
construction unit shall submit a report on the environmental impact. The
department of environmental protection shall, in examining and approving
the report, seek the opinion of the department of wildlife administration
at the same level.
Article 13
If natural disasters present threats to wildlife under special state or
local protection, the local governments shall take timely measures to
rescue them.
Article 14
If the protection of wildlife under special state or local protection
causes losses to crops or other losses, the local governments shall make
compensation for them. Measures for such compensation shall be formulated
by the governments of provinces, autonomous regions and municipalities
directly under the Central Government.

Chapter III Administration of Wildlife
Article 15
The departments of wildlife administration shall regularly carry out
surveys of wildlife resources and keep records of them.
Article 16
The hunting, catching or killing of wildlife under special state
protection shall be prohibited. Where the catching or fishing of wildlife
under first class state protection is necessary for scientific research,
domestication and breeding, exhibition or other special purposes, the unit
concerned must apply to the department of wildlife administration under
the State Council for a special hunting and catching license; where the
catching or hunting of wildlife under second class state protection is
intended, the unit concerned must apply to the relevant department of
wildlife administration under the government of a province, an autonomous
region or a municipality directly under the Central Government for a
special hunting and catching license.
Article 17
The State shall encourage the domestication and breeding of wildlife.
Anyone who intends to domesticate and breed wildlife under special state
protection shall obtain a license. Administrative measures for such
licenses shall be formulated by the department of wildlife administration
under the State Council.
Article 18
Anyone who intends to hunt or catch wildlife that is not under special
state protection must obtain a hunting license and observe the hunting
quota assigned. Anyone who intends to hunt with a gun must obtain a gun
license from the public security organ of the county or municipality
concerned.
Article 19
Anyone engaged in the hunting or catching of wildlife shall observe the
prescriptions in his special hunting and catching license or his hunting
license with respect to the species, quantity, area and time limit.
Article 20
In nature reserves and areas closed to hunting, and during seasons closed
to hunting, the hunting and catching of wildlife and other activities
which are harmful to the living and breeding of wildlife shall be
prohibited.
The areas and seasons closed to hunting as well as the prohibited hunting
gear and methods shall be specified by governments at or above the county
level or by the departments of wildlife administration under them.
Article 21
The hunting or catching of wildlife by the use of military weapons, poison
or explosives shall be prohibited.
Measures for the control of the production, sale and use of hunting rifles
and bullets shall be formulated by the department of forestry
administration under the State Council jointly with the public security
department, and shall enter into force after being submitted to and
approved by the State Council.
Article 22
The sale and purchase of wildlife under special state protection or the
products thereof shall be prohibited. Where the sale, purchase or
utilization of wildlife under first class state protection or the products
thereof is necessary for scientific research, domestication and breeding,
exhibition or other special purposes, the unit concerned must apply for
approval by the department of wildlife administration under the State
Council or by a unit authorized by the same department. Where the sale,
purchase or utilization of wildlife under second class state protection or
the products thereof is necessary, the unit concerned must apply for
approval by the department of wildlife administration under the government
of the relevant province, autonomous region or municipality directly under
the Central Government or by a unit authorized by the same department.
Units and individuals that domesticate and breed wildlife under special
state protection may, by presenting their domestication and breeding
licenses, sell wildlife under special state protection or the products
thereof, in accordance with the relevant regulations, to purchasing units
designated by the government.
The administrative authorities for industry and commerce shall exercise
supervision and control over wildlife or the products thereof that are
placed on the market.
Article 23
The transportation or carrying of wildlife under special state protection
or the products thereof out of any county must be approved by the
department of wildlife administration under the government of the relevant
province, autonomous region or municipality directly under the Central
Government, or by a unit authorized by the same department.
Article 24
The export of wildlife under special state protection or the products
thereof, and the import or export of wildlife or the products thereof,
whose import or export is restricted by international conventions to which
China is a party, must be approved by the department of wildlife
administration under the State Council or by the State Council, and an
import or export permit must be obtained from the state administrative
organ in charge of the import and export of the species which are near
extinction. The Customs shall clear the imports or exports after examining
the import or export permit. The export of the species of wildlife
involving scientific and technological secrets shall be dealt with in
accordance with relevant provisions of the State Council.
Article 25
The forgery, sale or resale or transfer of special hunting and catching
licenses, hunting licenses, domestication and breeding licenses, and
import and export permits shall be prohibited.
Article 26
Where any foreigner intends, in the territory of China, to make surveys of
or to film or videotape wildlife under special state protection in the
field, he must apply for approval by the department of wildlife
administration under the State Council or by a unit authorized by the same
department.
The establishment of hunting grounds open to foreigners must be approved
by the department of wildlife administration under the State Council.
Article 27
Anyone engaged in the utilization of wildlife or the products thereof
shall pay a fee for the protection and administration of wildlife
resources. The schedule of the fee and the procedure for collecting, it
shall be formulated by the department of wildlife administration under the
State Council jointly with the financial and pricing authorities and shall
enter into force after being submitted to and approved by the State
Council.
Article 28
Anyone who has caused losses to crops or other losses while hunting or
catching wildlife shall be held responsible for compensation.
Article 29
The local governments concerned shall take measures to prevent and control
the harm caused by wildlife so as to guarantee the safety of human beings
and livestock and ensure agricultural and forestry production.
Article 30
The administrative measures for wildlife under special local protection
and for other wildlife that is not under special state protection shall be
formulated by the standing committees of the people's congresses of
provinces, autonomous regions and municipalities directly under the
Central Government.

Chapter IV Legal Responsibility
Article 31
Anyone who illegally catches or kills wildlife under special state
protection shall be prosecuted for criminal responsibility in accordance
with the supplementary provisions on punishing the crimes of catching or
killing the species of wildlife under special state protection which are
rare or near extinction.
Article 32
If anyone, in violation of the provisions of this Law, hunts or catches
wildlife in an area or during a season closed to hunting or uses
prohibited hunting gear or methods for the purpose, his catch, hunting
gear and unlawful income shall be confiscated and he shall be fined by the
department of wildlife administration; if the circumstances are serious
enough to constitute a crime, he shall be prosecuted for criminal
responsibility in accordance with the provisions of Article 130 of the
Criminal Law.
Article 33
If anyone, in violation of the provisions of this Law, hunts or catches
wildlife without a hunting license or in violation of the prescriptions of
the hunting license, his catch and unlawful income shall be confiscated
and he shall be fined by the department of wildlife administration and, in
addition, his hunting gear may be confiscated and his hunting license
revoked.
If anyone, in violation of the provisions of this Law, hunts wildlife with
a hunting rifle without a license for the rifle, he shall be punished by a
public security organ by applying mutatis mutandis the provisions of the
Regulations on Administrative Penalties for Public Security.
Article 34
If anyone, in violation of the provisions of this Law, destroys in nature
reserves or areas closed to hunting the main places where wildlife under
special state or local protection lives and breeds, he shall be ordered by
the department of wildlife administration to stop his destructive acts and
restore these places to their original state within a prescribed time
limit, and shall be fined.
Article 35
If anyone, in violation of the provisions of this Law, sells, purchases,
transports or carries wildlife under special state or local protection or
the products thereof, such wildlife and products and his unlawful income
shall be confiscated by the administrative authorities for industry and
commerce and he may concurrently be fined. If anyone, in violation of the
provisions of this Law, sells or purchases wildlife under special state
protection or the products thereof, and if the circumstances are serious
enough to constitute a crime of speculation or smuggling, he shall be
prosecuted for criminal responsibility according to the relevant
provisions of the Criminal Law. The wildlife or the products thereof thus
confiscated shall, in accordance with the relevant provisions, be disposed
of by the relevant department of wildlife administration or by a unit
authorized by the same department.
Article 36
If anyone illegally imports or exports wildlife or the products thereof,
he shall be punished by the Customs according to the Customs Law; if the
circumstances are serious enough to constitute a crime, he shall be
prosecuted for criminal responsibility in accordance with the provisions
of the Criminal Law on the crimes of smuggling.
Article 37
If anyone forges, sells or resells or transfers a special hunting and
catching license, a hunting license, a domestication and breeding license,
or an import or export permit, his license or permit shall be revoked and
his unlawful income shall be confiscated and he may concurrently be fined
by the relevant department of wildlife administration or the
administrative authorities for industry and commerce.
If anyone who forges or sells or resells a special hunting and catching
license or an import or export permit, and if the circumstances are
serious enough to constitute a crime, he shall be prosecuted for criminal
responsibility by applying mutatis mutandis the provisions of Article 167
of the Criminal Law.
Article 38
Any staff member of a department of wildlife administration who neglects
his duty, abuses his power or engages in malpractices for personal gains
shall be subject to administrative sanctions by the department to which he
belongs or by the competent authority at a higher level; if the
circumstances are serious enough to constitute a crime, he shall be
prosecuted for criminal responsibility according to law.
Article 39
Any party who is dissatisfied with the decision on an administrative
sanction may, within 15 days of receiving the notification on the
sanction, make a request for reconsideration to the authority at the level
next higher to the one that made the decision on the sanction; if he is
dissatisfied with the decision on reconsideration made by the authority at
the next higher level, he may, within 15 days of receiving the
notification on the decision on reconsideration, institute legal
proceedings in the court. The party may also directly institute legal
proceedings in the court within 15 days of receiving the notification on
the sanction. If the party neither makes a request for reconsideration,
nor institutes legal proceedings in the court, nor complies with the
decision on the sanction, the authority that made the decision on the
sanction shall request the court to effect a compulsory execution of the
decision.
If the party is dissatisfied with a Customs penalty or a penalty for
violation of public security, the matter shall be dealt with in accordance
with the provisions of the Customs Law or the Regulations on
Administrative Penalties for Public Security.

Chapter V Supplementary Provisions
Article 40
If any international treaty concerning the protection of wildlife,
concluded or acceded to by the People's Republic of China, contains
provisions differing from those of this Law, the provisions of the
international treaty shall apply, unless the provisions are ones on which
the People's Republic of China has made reservations.
Article 41
The department of wildlife administration under the State Council shall,
in accordance with this Law, formulate regulations for its implementation
which shall go into effect after being submitted to and approved by the
State Council.
The standing committees of the people's congresses of provinces,
autonomous regions and municipalities directly under the Central
Government may, in accordance with this Law, formulate measures for its
implementation.
Article 42
This Law shall come into force as of March 1, 1989.
