《全國(guó)人民代表大會(huì)常務(wù)委員會(huì)關(guān)于懲治假冒注冊(cè)商標(biāo)犯罪的補(bǔ)充規(guī)定》已由中華人民共和國(guó)第七屆全國(guó)人民代表大會(huì)常務(wù)委員會(huì)第三十次會(huì)議于1993年2月22日通過(guò),現(xiàn)予公布,自1993年7月1日起施行。

1993年2月22日第七屆全國(guó)人民代表大會(huì)常務(wù)委員會(huì)第三十次會(huì)議通過(guò)
為了懲治假冒注冊(cè)商標(biāo)的犯罪行為,對(duì)刑法作如下補(bǔ)充規(guī)定:
一、未經(jīng)注冊(cè)商標(biāo)所有人許可,在同一種商品上使用與其注冊(cè)商標(biāo)相同的商標(biāo),違法所得數(shù)額較大或者有其他嚴(yán)重情節(jié)的,處三年以下有期徒刑或者拘役,可以并處或者單處罰金;違法所得數(shù)額巨大的,處三年以上七年以下有期徒刑,并處罰金。
銷售明知是假冒注冊(cè)商標(biāo)的商品,違法所得數(shù)額較大的,處三年以下有期徒刑或者拘役,可以并處或者單處罰金;違法所得數(shù)額巨大的,處三年以上七年以下有期徒刑,并處罰金。
二、偽造、擅自制造他人注冊(cè)商標(biāo)標(biāo)識(shí)或者銷售偽造、擅自制造的注冊(cè)商標(biāo)標(biāo)識(shí),違法所得數(shù)額較大或者有其他嚴(yán)重情節(jié)的,依照第一條第一款的規(guī)定處罰。
三、企業(yè)事業(yè)單位犯前兩條罪的,對(duì)單位判處罰金,并對(duì)直接負(fù)責(zé)的主管人員和其他直接責(zé)任人員依照前兩條的規(guī)定追究刑事責(zé)任。
四、國(guó)家工作人員利用職務(wù),對(duì)明知有本規(guī)定所列犯罪行為的企業(yè)事業(yè)單位或者個(gè)人故意包庇使其不受追訴的,比照刑法第一百八十八條的規(guī)定追究刑事責(zé)任。
對(duì)本規(guī)定所列的犯罪人員負(fù)有追究責(zé)任的國(guó)家工作人員,不履行法律所規(guī)定的追究職責(zé)的,依照刑法第一百八十七條或者比照刑法第一百八十八條的規(guī)定追究刑事責(zé)任。
五、本規(guī)定自1993年7月1日起施行。

Supplementary Provisions Concerning the Punishment of Crimes of
Counterfeiting Registered Trademarks Made by the Standing Committee of the
National People's Congress
(Adopted at the 30th Session of the Standing Committee of the
Seventh National People's Congress, on February 22, 1993)
In order to punish such criminal acts as to counterfeit registered
trademarks, the following supplementary provisions shall be made and added
to the Criminal Law:
1. Where any person uses, without the authorization of the proprietor of a
registered trademark, a trademark that is identical with the registered
trademark in question in respect of the same goods, and the amount of his
illegal income is considerable or he has committed other serious acts, he
shall be sentenced to fixed-term imprisonment of not more than three years
or criminal detention, or sentenced concurrently or exclusively to a fine;
where the amount of his illegal income is enormous, he shall be sentenced
to fixed-term imprisonment of not less than three years but not more than
seven years and concurrently to a fine.
Where any person sells goods that he knows bear a counterfeited registered
trademark, and the amount of his illegal income is considerable, he shall
be sentenced to fixed-term imprisonment of not more than three years or
criminal detention, or sentenced concurrently or exclusively to a fine;
where the amount of his illegal income is enormous, he shall be sentenced
to fixed-term imprisonment of not less than three years but not more than
seven years and concurrently to a fine.
2. Where any person counterfeits, or makes, without authorization,
representations of a registered trademark of another person, or sells such
representations of a registered trademark as were counterfeited, or made
without authorization, and the amount of his illegal income is
considerable or he has committed other serious acts, he shall be punished
according to the provisions of Paragraph 1 of Article 1 above.
3. Where any enterprise or institution has committed any of such crimes as
enumerated in the preceding two articles, it shall be sentenced to a fine,
and the person in charge who is directly responsible and any other persons
who are directly responsible shall be prosecuted, according to the
provisions of the preceding two articles, for their criminal liabilities.
4. Where any functionary of the State exploits his office to intentionally
harbour any enterprise, institution or individual that he knows to be
guilty of any of such criminal acts as enumerated in these Provisions and
make it or him to escape being prosecuted, he shall be prosecuted, mutatis
mutandis under the provisions of Article 188 of the Criminal Law, for his
criminal liabilities.
Where any functionary of the State who is responsible for prosecuting such
criminals as enumerated in these Provisions fails to perform his functions
of prosecution as prescribed by law, he shall be prosecuted, according to
the provisions of Article 187 of the Criminal Law or mutatis mutandis
under the provisions of Article 188 of the Criminal Law, for his criminal
liabilities.
5. These Provisions shall enter into force on July 1, 1993.
