第七屆全國(guó)人民代表大會(huì)第三次會(huì)議決定:
一、批準(zhǔn)香港特別行政區(qū)基本法起草委員會(huì)關(guān)于設(shè)立全國(guó)人民代表大會(huì)常務(wù)委員會(huì)香港特別行政區(qū)基本法委員會(huì)的建議。
二、在《中華人民共和國(guó)香港特別行政區(qū)基本法》實(shí)施時(shí),設(shè)立全國(guó)人民代表大會(huì)常務(wù)委員會(huì)香港特別行政區(qū)基本法委員會(huì)。
附件:香港特別行政區(qū)基本法起草委員會(huì)關(guān)于設(shè)立全國(guó)人民代表大會(huì)常務(wù)委員會(huì)香港特別行政區(qū)基本法委員會(huì)的建議
一、名稱:全國(guó)人民代表大會(huì)常務(wù)委員會(huì)香港特別行政區(qū)基本法委員會(huì)。
二、隸屬關(guān)系:是全國(guó)人民代表大會(huì)常務(wù)委員會(huì)下設(shè)的工作委員會(huì)。
三、任務(wù):就有關(guān)香港特別行政區(qū)基本法第十七條、第十八條、第一百五十八條、第一百五十九條實(shí)施中的問(wèn)題進(jìn)行研究,并向全國(guó)人民代表大會(huì)常務(wù)委員會(huì)提供意見(jiàn)。
四、組成:成員十二人,由全國(guó)人民代表大會(huì)常務(wù)委員會(huì)任命內(nèi)地和香港人士各六人組成,其中包括法律界人士,任期五年。香港委員須由在外國(guó)無(wú)居留權(quán)的香港特別行政區(qū)永久性居民中的中國(guó)公民擔(dān)任,由香港特別行政區(qū)行政長(zhǎng)官、立法會(huì)主席和終審法院首席法官聯(lián)合提名,報(bào)全國(guó)人民代表大會(huì)常務(wù)委員會(huì)任命。

DECISION OF THE NATIONAL PEOPLE'S CONGRESS APPROVING THE PROPOSAL
BY THE DRAFTING COMMITTEE FOR THE BASIC LAW OF THE HONG KONG SPECIAL
ADMINISTRATIVE REGION ON THE ESTABLISHMENT OF THE COMMITTEE FOR THE BASIC
LAW OF THE HONG KONG SPECIAL ADMINISTRATIVE REGION UNDER THE STANDING
COMMITTEE OF THE NATIONAL PEOPLE'S CONGRESS
(Adopted at the Third Session of the Seventh National People's
Congress on April 4, 1990)
The Third Session of the Seventh National People's Congress decides:
1. to approve the proposal by the Drafting Committee for the Basic Law of
the Hong Kong Special Administrative Region on the Establishment of the
Committee for the Basic Law of the Hong Kong Special Administrative Region
under the Standing Committee of the National People's Congress; and
2. to establish the Committee for the Basic Law of the Hong Kong Special
Administrative Region under the Standing Committee of the National
People's Congress when the Basic Law of the Hong Kong Special
Administrative Region of the People's Republic of China is put into
effect.
Appendix
Proposal by the Drafting Committee for the Basic Law of the Hong Kong
Special Administrative Region on the Establishment of the Committee for
the Basic Law of the Hong Kong Special Administrative Region Under the
Standing Committee of the National People's Congress
1. Name: The Committee for the Basic Law of the Hong Kong Special
Administrative Region Under the Standing Committee of the National
People's Congress.
2. Affiliation: To be a working committee under the Standing Committee of
the National People's Congress.
3. Function: To study questions arising from the implementation of
Articles 17, 18, 158 and 159 of the Basic Law of the Hong Kong Special
Administrative Region and submit its views thereon to the Standing
Committee of the National People's Congress.
4. composition: Twelve members, six from the mainland and six from Hong
Kong, including persons from the legal profession, appointed by the
Standing Committee of the National People's Congress for a term of office
of five years. Hong Kong members shall be Chinese citizens who are
permanent residents of the Hong Kong Special Administrative Region with no
right of abode in any foreign country and shall be nominated jointly by
the Chief Executive, President of the Legislative Council and Chief
Justice of the Court of Final Appeal of the Region for appointment by the
Standing Committee of the National People's Congress.
